植物新品种是经过人工培育的或者对发现的野生植物加以开发,具有新颖性、特异性、一致性和稳定性并有适当命名的植物品种.对于植物新品种的法律保护模式,国际公约和各国国内法却存在着较大的差异,主要有只授予植物新品种品种权、只授予植物新品种专利权、植物新品种品种权和专利权双重保护三种模式.本文从我国植物新品种保护的现状和对世界社会植物新品种保护模式对比分析入手,对我国今后植物新品种保护立法可采用的模式和相关措施提出了自己的见解.
本文主文分为四个部分.
第一部分是植物新品种及植物新品种权的基本理论,主要介绍了植物、植物新品种和植物新品种权的概念和特征,分析植物新品种保护的意义,并指出了植物新品种权保护存在的问题和难点.
第二部分对目前我国植物新品种法律保护体系及其问题进行评述,主要介绍了我国植物新品种保护实施的社会背景和现行的植物新品种保护法律制度.虽然我国植物新品种法律保护体系日趋完善、保护范围不断扩大、申请数量大幅上升、产业趋向市场化,但仍存在保护法律法规的内容不够全面系统、法律层次过低、保护名录偏少、新品种申请领域发展不均衡、创新能力不足、品种权人维权成本较高等诸方面的问题.
第三部分对国际社会现行的植物新品种保护模式对比分析,简要回顾植物新品种国际保护的发展历程,对《植物新品种保护公约》（upovc公约）两个文本进行了对比,介绍并分析了日本、欧洲、美国植物新品种保护的法律保护模式的主要特点,对我国今后完善植物新品种立法具有很强的借鉴意义.
第四部分对完善我国植物新品种法律保护立法模式及相关措施提出对策.通过对我国及世界社会植物新品种法律保护发展状况的研究分析,得出结论：建议尽快加入《植物新品种保护公约》（upovc公约）91文本,扩大品种保护范围,增强对品种权的保护力度；适应生物技术保护的国际发展趋势,尤其是转基因植物新品种越来越多,适当时机应将植物新品种纳入专利法保护体系,提高对新品种的保护强度,甚至可以考虑实行美国的“双重选择”模式；提升植物新品种保护法律层次,及早制定《植物新品种保护法》.同时,提出了植物新品种保护宣传教育、科技创新、配套体系建设等方面的相关措施,切实为推进植物新品种保护工作提供可靠保障.
